Dawg comments on ML regarding Parcel 36 …

Campers,

It was a tough day for me and Skippy but we got through it with all of our errands run and at nearly 3am I’m finishing up my review of what the fuck was happening while I was otherwise occupied.

Here’s my offering to ML on the Parcel 36 hearing …

Campers,

There was hearing earlier tonight and I hope ML covered it.

Pretty epic.

Boiled down to a single question on the request for a permit to replace East Gate.

Under ‘applicant’ it asks if you are, ‘owner’ or the ‘agent’ of the Lot and the Assistant Planning Department Zoning Administrator first noted that her department had searched and they (Planning Department) could not find the owner.

No one has for 40 years.

Menendez said that he explained to the Clerk at DBI that he had searched also but was also unsuccessful, so, after consultation with the clerk who smelled big trouble down the road if he approved this, Alex checked both the ‘owner’ and ‘agent’ box.

There was no third box for ‘easement’ which is, in fact, the status of every owner adjoining the lot as regards their use of the lot.

So, he checked both boxes.

The Asst. Zoning Administrator jumped on it and in a harsh tone said something to the effect of (meeting not archived yet or I’d have names here) …

"Checking that box was a lie and Planning will not allow a project based on a lie to go forward."

I’ll get that exactly when they post the rerun later this morning I hope but that’s close.

Frankly, I was surprised that Planning was even there and I certainly did not expect such a spirited attack by their representative.

It turned the hearing on its ear.

Chair Rick Swig exclaimed that it was the clearest explanation of the matter he’d heard and made his decision for him.

Earlier, I thought that Rick being a ‘Native’ San Franciscan (why do they have to always bring that up like they had a choice in the matter?) …

Swig pointed at the 25 people ready to testify for Appellant who has no property adjoining the Parcel and began to preach to Alex and Rudy about how if you claimed use of a property in San Francisco that you did not own that San Franciscans respected your claim.

He pointed to the line to prove his point.

Reminded me of Putin pointing to areas of Northern Ukraine his troops had occupied as now a part of, Greater Russia.

So, they shot down the permit and Alex and Rudy was lucky they didn’t shoot them down.

Chair Swig closed the session suggesting that the Board of Appeals send a letter to Supervisor Hillary Ronen telling her: "Do your job !!" (emphasis, his).

His Vice Chair, I believe (I’ll get names later) said he’d be glad to write it.

Despite the fact that all parties had already testified that Ronen and her office had met with them and visited the property trying to reconcile the matter many times.

Put bluntly, the Mayor’s people hate Ronen and this was just another platform for them to trash talk her.

London appoints three of the five members of the body (thanks to Matt Gonzalez; before that, Willie had all 5) … so, she’s gonna win on every issue and is gonna project her own disdain for my area Supervisor every way she can.

Saddest thing to me were all of the really wonderful young people who came up and spoke against Monkey Brains who will certainly change their minds and be embarrassed later when they learn the facts.

I went to the site this morning with my dog and took some pictures and what you see are two loading docks to Monkey Brains warehouse that have been surrounded by wooden planters which will now remain and allow Appellant to continue to block the Native IT company from using its facility once the interior renovation is complete as they aren’t even in the building yet.

I hope this doesn’t wreck another successful SF business, crushed on the rocks of a famous bureaucracy that has done the same thing before then vilified their victims.

How many other SF locations have you seen closed before they even opened because of decisions by bodies such as the Board of Appeals in this case.

Which ruled that the lot is open to anyone who wants to be there and then DBI said that if anyone complained about the damaged fence Monkey Brains wanted to replace?

DBI who would be unable to find the owner would have to tear it down.

I ask you, is than an invitation to a homeless encampment or what ?

Warriors took care of business,

Let me make note on me and Skippy and our failing bodies.

I started my walk to the Parcel cheerfully with Skippy pattering down the heart of Mission Street from 14th to 22nd with him winning hearts and they really are chick magnets tho by this point in my life I got him mostly so’s people would stop thinking I was talking to myself all the time.

That’s only partly true.

So, I’m guessing that’s a good mile and I was limping from what I hope is a pulled muscle and not shot hip joint like my ole man had at this point …

Did not realize two things about my dog.

First, he has no stamina.

Second, he fakes leg injuries for sympathy.

Not really sure about the second.

Maybe his Rabies shot has him limping.

So, I end up carrying the dog half of the time from about 20th on to the target site and all the way back.

Must have looked funny.

Here’s this old bearded guy in a straw hat sitting on the sidewalk with his dog, both panting and trying to get up and make it another block.

Hmmmm

Maybe that’s not an odd sight at all round these parts.

Anyway, we made it.

I knew that our building’s elevator was down for last few days and will be for at least a few more and almost everyone in the building is a disabled vet.

It’s 5 stories and I live 4th level.

So, we get to my front door and here’s a neighbor from top floor above me and she’s my era (old) and somewhat lame too …

And, she’s unloading her 6 bags of groceries from a cab and putting them a couple at a time next to our door, moving dangerously across the bike land atween her and the sidewalk in front of our door.

As Skippy and I approach, a tall unkempt street lady staggered and veered in between the little old lady and her groceries and tried to help herself to one of the bags.

I hit her with Bear Spray and Skippy bit her.

No, no, didn’t even think of it altho by this time I was plumb outta patience.

I just barked a loud, "HEY !!!" and the lady dropped the bag and kept on.

I helped her thru the door and to the stairs while a ‘lobby rat’ sat reading a book pretending not to notice.

She walked to the elevator and remembered it was broken.

Now, probably like you, I’m torn like a mother fucker as to what was the right thing to do.

No, not just the ‘right thing’, but the ‘most noble’ ?

I told her I’d take my dog upstairs and come back to help while looking at the tenant to offer help.

He musta been a City bureaucrat in another life.

Our plight did not phase him one fucking bit.

So, I just grabbed two of the bags and the three of us started up Mt. Everest.

By the second floor she was a landing behind with her 4 bags and I came back and retrieved the 2 heaviest and kept on trucking.

By the time I’d reached my floor on the 4th level I thought of letting the dog off the leash and into my hallway but I live all the way at the other end and …

So, she’s 2 floors behind now and I call for her apartment number and leave her groceries at her door.

It was all I could do to stay awake (oh, yes, I did smoke some good weed soon as I got thru the door) …

So, I tuned in the Appeals Board hearing on Parcel 36 and shook my head at what Skippy and I had witnessed a few hours earlier and what was being said before that body and what the members of that body were saying.

Which brings me back to what has blended into my favorite, ‘Witching Hour’ of 3 to 4 am.

And, around to where I started with my ML comment I think.

Upsides ?

Monkey Brains will survive and thrive cause they’re gold and the neighbors will realize that.

Skippy and I actually had very productive day.

I was able to get his City License for $14 even tho, like Parcel 36, there is some question about his previous owners.

He’s up to date with his shots and meds cost $124 and I picked those up this morning from his old Vet who doesn’t do charity work.

I got a notice saying my rent increased by $43 a month which is a 16% increase to $302 which beats last year when they lied and tried to toss me out and 145 of them got fired which is another story.

That’s enuff for this one today …

Go Niners !!
